PRIVACY POLICY

PLEASE READ AND MAKE SURE YOU UNDERSTAND THIS PRIVACY POLICY (THE “POLICY”). BY ACCESSING AND INTERACTING WITH THE SERVICE, YOU CONSENT TO THIS POLICY. IF YOU DO NOT WISH TO BE BOUND BY THIS POLICY, PLEASE DISCONTINUE YOUR USE OF THE SERVICE IMMEDIATELY.

Purpose of This Policy

This Policy explains how Saturn Cloud, Inc. (the “Company”, “SATURN,” “we,” “our” or “us”) collects, stores, uses, and discloses information (the “Information”) from and about our users (“you” or “your”), including personally-identifiable information, in connection with SATURN’s data analytics platform, website and related services (the “Service”). Any reference to “you” or “your” in this Policy also includes the organization on whose behalf you are accessing the Service (the “Organization”).

Changes to This Policy

We reserve the right to modify this Policy at any time without prior notice to you, and the revisions will be effective upon our posting updates to this website. If you access the Service after a revision is posted, your use will constitute acceptance of the revision.

How We Collect Your Information

This Policy applies to Information we collect about you and your use of the Service, but does not apply to any services or products offered by third parties and made available to you through our Service.

We collect Information in the following ways:

(i) Information provided by you: You may be required to register for a SATURN account in order to access certain features of the Service. To become a registered user, you may be required to provide personal information such as your email address. Additionally, when filling out your SATURN profile, you may choose to provide additional Information about yourself, such as your name, address, phone number, picture and a brief description about yourself, as well as Information about your Organization, such as the Organization’s name and domain. You may also choose to provide Information about other individuals at such Organization if you wish to invite them to the Service.

(ii) Information we obtain from third parties: While using the Service, including as part of registering for a SATURN account, you may choose to share with us Information about yourself, in which case we will collect Information about you from such third parties. For example, you may choose to sign up for a SATURN account with a third-party service such as Google . As part of the functionality of the Service, you may also choose to connect or upload your data, data sources, data process and other information to the Service to create charts, graphs and reports. For example, you may grant us access to your Amazon Web Services Virtual Private Cloud. Additionally, if another user from your Organization invites you to the Service, we will collect the Information such user shares with us for the purpose of inviting you to the Service.

(iii) Information obtained while you use the Service: We may automatically collect certain Information about how you interact with the Service, such as usage data, preferences, or any other data that includes Information concerning how you use the Service. We use this Information to better understand our users and to improve the Service. In particular, we may collect the following Information as you use the Service: ” Your browser type, language, plug-ins, Internet domain, operating system and Internet Protocol (IP) address; ” The website(s) you visited before and after visiting the Service; ” Unique identifiers, including mobile device identification numbers, that may identify the physical location of such devices; ” Data collected through cookies and other similar tracking technologies; and ” Data related to your interactions with content on the Service, such as the type of content viewed in the Service.

Cookies and Similar Technologies

What are cookies: A cookie is a small text file placed on your browser, which you may be able to refuse to accept by activating the appropriate setting within your browser. We use cookies as part of the Service as described below.

Essential cookies: We use essential cookies to provide the functionality of the Service. For example, these cookies enable you to log-in to your registered SATURN account. Because such cookies are necessary to deliver the Service to you, you will not be able to use the Service without them.

Analytics cookies: We also use third-party vendors, including, but not limited to, Mixpanel, Zendesk and Facebook, which allow us to collect data about our users through cookies. We do this to understand how you interact with the Service, and to better tailor the Service to you. Please note that your Information may be shared with such third parties for the purpose of providing us with such analytics services. We encourage you to view the respective policies of such third parties to learn more about how they collect and retain your Information.

We may share certain Information with third-party vendors who supply software applications, web hosting, payment processing and other technologies for the functionality of the Service. We will only provide these third parties with access to Information that is reasonably necessary to perform their work or comply with the law. We take reasonable measure to ensure those third parties are obligated not to use or disclose such Information for any other purpose except to provide the functionality of the Service.

We will not share any of your Information to any third party except as otherwise stated in this Policy and in the following circumstances: (a) in response to subpoenas, court orders or legal process, to the extent permitted and as restricted by law; (b) when disclosure is required to maintain the security and integrity of the Service, or to protect any user’s security or the security of other persons, consistent with applicable laws; (c) when you consent to such disclosure; (d) in the event that we go through a business transition, such as a merger, divestiture, acquisition, liquidation or sale of all or a portion of our assets; (e) in order to comply with any applicable laws and regulations, or (f) to protect and defend our rights and/or property.

How We Secure Your Information

Information provided by you is protected by the login and password you create when registering to use the Service. Please understand that you can help prevent the unauthorized disclosure of Information by choosing and protecting your password appropriately. You can also help prevent unauthorized disclosure by not sharing your password and preventing others from using your computer or mobile device.

We use commercially reasonable procedures to protect your Information. However, please understand that no security system is perfect and, as such, we do not guarantee the security of the Service, or that your Information won’t be intercepted while being transmitted to us. As such, we are not responsible for any loss, misuse, or alteration of your Information.

How We Store and Retain Your Information

Please note that we generally retain Information about our users as long as necessary to provide the functionality of the Service, as instructed by users or otherwise as required by law. This may require that we retain your Information after your account has been terminated for the period of time needed for us to pursue legitimate business interests, conduct audits, comply with and demonstrate compliance with legal obligations, resolve disputes and enforce our rights. If you would like to access your information or would like us to delete or modify your information, you may contact us by email at support@saturncloud.io. However, we may also keep your Information as otherwise required by law.

To continue to improve the Service, we may anonymize your Information in a way that does not personally identify you and store such anonymized Information perpetually.

We store and process certain Information on servers in many countries around the world. We may store and process your Information on a server located outside the country where you live. If you are a resident of the European Union or Switzerland, please see section below “Privacy Shield – International Data Transfers.”

Your California Privacy Rights

If you reside in California, you have the right to ask us one time each year if we have shared Information with third parties for their direct marketing purposes. To make a request, please send us an email at support@saturncloud.io. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

Privacy Shield – International Data Transfers

If you choose to use the Service from the European Union (“EU”), Switzerland or other regions of the world with laws governing data collection and use that may differ from the law of the United States of America (“US”), this section titled “Privacy Shield – International Data Transfers” applies to your use of the Service. Please note that you are transferring your Information outside of those regions to the US for storage and processing. By providing any Information on or to the Service, you consent to such transfer, storage, and processing.

We participate in, and comply with, the EU-US Privacy Shield Principles (the “Privacy Shield Principles”) regarding the collection, use, sharing, and retention of personal data collected from users in the EU. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Our participation in the EU-US Privacy Shield applies to all personal data that is subject to this Policy and is received from the EU. We will comply with the Privacy Shield Principles in respect of such personal data. As used in this Policy, the terms “personal data” and “processing” have the meanings specified in the Privacy Shield Principles.

As part of our participation in Privacy Shield, if you have a dispute with us about our adherence to the Privacy Shield Principles, we will seek to resolve it through JAMS, an independent alternative dispute resolution body based in the US. In certain circumstances, you may have the right to invoke binding arbitration under Privacy Shield, as described in Annex I to the Privacy Shield Principles, which can be found at the following URL here.

As a Privacy Shield participant, we are subject to the investigatory and enforcement powers of the US Federal Trade Commission and other authorized statutory bodies. Under certain circumstances, we may be liable for the transfer of personal data that we receive and subsequently transfer to a third party, as described in the Privacy Shield Principles.

As described in this Policy, we may share personal data with third parties and may be required to disclose information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Finally, you may contact us at support@saturncloud.io to request access to your personal data to be able to correct, amend, or delete that information where it is inaccurate or has been processed in violation of the Privacy Shield Principles, or to request that your personal data not be used for a purpose that is materially different from the purposes for which it was originally collected or for purposes subsequently authorized by you. You may also contact us to request that we do not disclose your personal data to third parties (other than those that are acting as our agent to perform tasks on our behalf, such as payment and data processors).

Areas Beyond Our Control

You may be able to share and post certain Information about yourself and your Organization in public portions of the Service. For example, you may choose to share one or more of your “notebooks” with other users. Please remember that any Information that is disclosed in these areas becomes public information, and you should exercise caution when deciding which Information to disclose. In addition, while the Service may contain links to third-party websites, we do not endorse such third-party websites and are not responsible for their privacy policies and/or practices. Where we have linked to a third-party website you should read the privacy policy stated on that third-party website.
